Terms and Conditions

Welcome to RijSys. These terms and conditions apply to the use of the RijSys system, the mobile applications, websites and all additional services of RijSys. By creating an account, starting a trial period or taking out a subscription, the driving school agrees to these terms and conditions.

1. Definitions

In these terms, the following definitions apply:

  • RijSys: the online system, the mobile applications, websites and additional services offered by RijSys.
  • Driving school: the business that uses the RijSys system.
  • User: any person who has access to the system through a driving school, including owners, employees, instructors and students.
  • Subscription: the monthly right to use the RijSys system.

2. Applicability

These terms apply to all agreements, subscriptions, websites, mobile applications and additional services of RijSys. Deviations are only valid when confirmed in writing by RijSys.

3. The RijSys system

RijSys is a complete software system for Dutch driving schools. Depending on the chosen subscription, the following components may be available, among others:

  • Student management
  • Scheduling
  • Calendars
  • Instructors
  • Courses
  • Invoices
  • Payments
  • CBR integrations
  • Online registration
  • Messages
  • Student app
  • Instructor app
  • Websites
  • Reports
  • Additional modules

RijSys develops the system continuously. Features may be added, improved or adjusted to further optimize the service.

4. Account

An account is required to use RijSys. The driving school is responsible for:

  • managing users;
  • keeping login credentials confidential;
  • the use of the system within its own organization.

Users may not share their account with third parties. In the event of misuse, fraud or security risks, RijSys may temporarily block or terminate accounts.

5. Subscription

RijSys is offered as a monthly subscription. The subscription price depends on the chosen configuration of the driving school, including the number of courses, calendars and any additional modules. RijSys may offer temporary introductory rates to new customers. After a promotional or introductory period ends, the regular rate communicated to the customer in advance automatically applies.

6. Free trial period

New driving schools can make use of a free trial period. The trial period ends automatically as soon as one of the following situations occurs:

  • six months have passed; or
  • 21 active students have been reached.

After the trial period ends, the subscription can be activated immediately. After payment of the first verification payment, the monthly subscription starts automatically.

7. Payments

Subscriptions are collected automatically each month. If an automatic payment fails, RijSys will attempt to process the payment up to three more times. If payment then remains outstanding, access to the system may be temporarily suspended. Once the outstanding payment is received, the account is automatically reactivated. Outstanding payment obligations remain fully in force.

8. Changing the subscription

The driving school can expand the subscription at any time. Expansions become active immediately after the additional payment has been processed successfully. Reducing the number of courses, calendars or additional modules is possible from the next billing period. To do so, unused components must first be removed or deactivated from the system.

9. Cancelling the subscription

The driving school can cancel the subscription at any time by sending an email to [email protected]. After the cancellation is received, the subscription remains active for:

  • the current billing period; and
  • one full subsequent billing period.

After this period the subscription is automatically terminated and no new subscription costs are charged. During this period the RijSys system remains fully available, so the driving school has enough time to review and export available data.

10. Data after termination

After termination of the subscription, RijSys retains the driving school’s data for a maximum of 90 days. Within this period the subscription can be reactivated, after which the data becomes available again. After this period the data is permanently deleted, unless the driving school has previously requested immediate deletion in writing or a statutory retention obligation applies.

11. Ownership of data

All data entered into the system by the driving school or its users remains the property of the driving school. This includes, among other things:

  • student data;
  • calendars;
  • lessons;
  • courses;
  • invoices;
  • payments;
  • notes;
  • logos;
  • images;
  • documents;
  • other files.

RijSys uses this data solely to provide, maintain and improve the agreed services.

12. Websites and mobile applications

Depending on the chosen subscription, RijSys may provide additional services, including:

  • a website for the driving school;
  • a student app;
  • an instructor app;
  • additional modules;
  • custom functionalities.

These services are linked to the active subscription. When a subscription is terminated or temporarily suspended due to a payment arrear, the associated websites, mobile applications and additional services may also be temporarily or permanently taken out of use.

13. Availability of the system

RijSys strives for a reliable and stable service. Maintenance, updates or technical work may temporarily affect the availability of the system. Planned maintenance is announced in advance where possible. Although RijSys makes every effort to resolve malfunctions as quickly as possible, uninterrupted availability cannot be guaranteed.

14. External services

RijSys supports integrations with external services, including for example:

  • CBR
  • Mollie
  • Google Maps
  • TOP Internet

RijSys is not responsible for malfunctions, changes or interruptions caused by these external service providers. When an external service is temporarily unavailable, this may affect certain functions within the system.

15. Support

RijSys provides support on working days. Regular support is available Monday to Friday, 09:00–17:30. Questions submitted outside these hours are handled as soon as possible on the next working day.

16. Price changes

RijSys may change subscription rates and prices of additional services from time to time. Price changes are communicated to the driving school at least 30 days in advance. Temporary introductory prices or promotions apply only during the stated period. Afterwards the regular rate automatically applies.

17. Intellectual property

All intellectual property rights relating to the RijSys system, the websites, mobile applications, designs, software, source code, documentation, images, texts and other materials remain the property of RijSys. It is not permitted to copy, distribute, modify, sell, rent or otherwise use parts of the system without the prior written consent of RijSys.

18. Security

RijSys takes appropriate technical and organizational measures to secure the system and the stored data against loss, unauthorized access or misuse. Each user remains responsible for handling their login credentials carefully.

19. Liability

RijSys strives for a reliable and secure system, but cannot guarantee that the system is always available without interruptions or errors. RijSys is not liable for indirect damage, consequential damage, loss of turnover, loss of profit or damage arising from improper use of the system. The total liability of RijSys is, to the extent permitted by law, limited to the amount the driving school paid in subscription costs in the three months preceding the event giving rise to the damage.

20. Force majeure

RijSys is not liable for delays or malfunctions beyond its reasonable control. This includes, among other things:

  • outages at internet providers;
  • power failures;
  • outages at CBR;
  • outages at Mollie;
  • outages at hosting providers;
  • cyberattacks;
  • government measures;
  • other situations of force majeure.

21. Privacy

The processing of personal data is governed by the RijSys Privacy Policy. RijSys processes personal data in accordance with the General Data Protection Regulation (GDPR).

22. Changes

RijSys may amend these terms and conditions from time to time. The most current version is always available at www.rijsys.nl. Customers are informed in advance of significant changes.

23. Applicable law

All agreements and the use of the RijSys system are governed exclusively by Dutch law. Disputes are submitted to the competent court in the Netherlands.
